Welcome to La Onda VIP. These Terms & Conditions ("Terms") govern your access to and use of the La Onda VIP website, broadcast channels, and related services (collectively, the "Service"). Please read them carefully. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

The Service is operated by Tulum Vibe LLC, a limited liability company organized under the laws of the State of Wyoming, United States ("we," "us," or "our"). La Onda VIP is a brand operated by Tulum Vibe LLC.

2. What La Onda VIP Is

La Onda VIP is an information and discovery platform. We aggregate, organize, and publish information about events, nightlife, tours, venues, and activities in the Riviera Maya and surrounding areas. This information is gathered from third-party sources, including event organizers, venues, public posts, and partner channels.

We are not the organizer, promoter, host, operator, or seller of the events, tours, venues, or activities listed on the Service. We do not sell tickets, process event payments, or control the experiences described. We simply help you discover them.

3. Accuracy of Information

We work to keep listings accurate and up to date, but event details — including dates, times, locations, pricing, lineups, age restrictions, and availability — are set by third parties and can change or be cancelled without notice.

We provide all information "as is" and "as available," without warranty of any kind. We do not guarantee that any listing is accurate, complete, current, or that any event will take place as described. Always confirm details directly with the venue or organizer before making plans, traveling, or spending money.

4. Third-Party Links, Partners & Affiliate Relationships

The Service contains links to third-party websites, tour operators, ticketing providers, and booking platforms (for example, GetYourGuide, Viator, and similar partners). Some of these are affiliate links, which means we may earn a commission if you make a booking or purchase through them, at no additional cost to you.

These third parties are independent businesses with their own terms, pricing, privacy practices, and cancellation policies. We do not control and are not responsible for third-party websites, services, bookings, or transactions. Any purchase or booking you make is a contract between you and that third party. Please review their terms before booking.

5. Bookings, Payments & Refunds

We do not process payments for events or tours. All bookings, payments, refunds, cancellations, and disputes are handled by the relevant third-party organizer, venue, or booking platform under their own policies. We are not a party to those transactions and cannot issue refunds or resolve disputes on their behalf.

6. Age Requirements & Assumption of Risk

Many events and venues listed on the Service involve nightlife, alcohol, or other activities that are restricted to adults. You are responsible for confirming and complying with all applicable age restrictions and local laws. Some venues may require you to be 18 or older (or another minimum age set by the venue or by law).

You acknowledge that attending events, tours, and activities carries inherent risks, and you assume full responsibility for your own safety, conduct, and decisions. We are not liable for anything that happens to you at, traveling to, or in connection with any event or activity discovered through the Service.

7. Acceptable Use

When using the Service, you agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Copy, scrape, republish, or commercially exploit our content without permission.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
• Impersonate any person or misrepresent your affiliation with anyone.
• Upload or transmit malicious code or harmful content.

We may suspend or terminate access for anyone who violates these Terms.

The "La Onda VIP" name and branding may not be used without our prior written permission. Event information and third-party content remain the property of their respective owners.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Tulum Vibe LLC and its members, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service, your reliance on any listing, or your attendance at or interaction with any third-party event, venue, or service — even if we have been advised of the possibility of such damages.

Where liability cannot be excluded, our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us, if any, in the twelve months before the claim, or (b) USD $100.

11. Indemnification

You agree to indemnify and hold harmless Tulum Vibe LLC and its members, officers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to those practices.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes may be communicated through the Service. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles. To the extent permitted by law, any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in Sheridan County, Wyoming, and you consent to their jurisdiction. Nothing in these Terms limits any mandatory consumer-protection rights you may have under the laws of your country of residence.
